DiBiaggio Law Announces Six-Figure Settlements for Workers’ Comp Cases

Personal Injury Attorney Deirdre DiBiaggio, Founder of DiBiaggio Law in West Palm Beach, Florida, announces the achievement of six-figure settlements on behalf of workers’ compensation clients and Social Security Disability clients.

In Florida, the Workers’ Compensation System compensates individuals injured on the job for some of their losses to help them recover and return to work as soon as possible. Florida Workers’ Compensation covers:

  • Temporary Disability Benefits
  • Permanent Impairment Benefits
  • Permanent Total Disability Benefits
  • Authorized medical care

Most Florida employers must carry workers’ compensation insurance, either through a private insurance company or by obtaining state certification to self-insure. In Florida’s no-fault workers’ compensation system, the injured employee does not have to prove negligence or carelessness by their employer. The only requirement to file a South Florida workers’ compensation claim is that the injury occurred on the job or resulted from work-related activities.

Workers’ compensation injuries are not limited to severe onsite injuries in physically demanding jobs. Employees in various fields in a broad spectrum of industries can sustain workers’ compensation injuries on the job. The six most common include:

  • Overexertion
  • Slip, Trip, and Falls
  • Repetitive Strain Injuries
  • Struck by or Against an Object
  • Highway Accidents
  • Machinery Accidents

In addition to serving clients in workers’ compensation cases, DiBiaggio helps clients apply for Social Security Disability Benefits awarded by the Social Security Administration or an Administrative Law Judge. Of the more than 11 million residents in Florida, about 461,000 receive social security disability benefits. To qualify for  Florida Social Security Disability benefits, an individual must meet the Social Security Administration’s (SSA) guidelines for disability. According to the SSA definition, to meet the requirements, a person must have a severe medical condition anticipated to last more than one year or may result in death. They must be unable to perform their past relevant work or past jobs before becoming disabled and cannot perform other work in the national economy. In addition to fulfilling the Social Security Administration’s definition of disability, an individual must have worked and paid taxes for a long enough period to qualify for Social Security Disability coverage or be a low-income individual.

According to the Blue Book, the Social Security Administration’s medical impairment listing manual defines the severity of common medical conditions that qualify for Social Security Disability benefits, including, but not limited to:

  • Back injuries
  • Heart failure or coronary artery disease
  • COPD or asthma
  • Immune system disorders
  • Liver disease or IBD
  • Cancer
  • Severe mental health conditions-  Major Depression, Anxiety, Schizophrenia, ADD, ADHD, learning disabilities
  • Neurologic conditions

“I’m delighted to announce our success in obtaining the best possible outcomes for DiBiaggio Law clients who seek our representation for workers’ compensation injuries and our assistance with Social Security Disability claims,” says DiBiaggio. “It is my passion to fight for the rights of the injured.
