How Do Bail Bonds Work?

Bail bonds are a conditional loan provided to a “cosigner”. Bail bonds allow an individual the ability to post bail for a loved one, even if they only physically have a fraction of the bail amount. This service is provided by the bail bond company for an openly agreed upon fee, discussed in advance of providing the loan. Bail is essentially collateral for the court, giving an accused individual the opportunity to await his/her arraignment in the comfort of home. Bail itself is not meant to be a fine or additional fee to the defendant. It is refunded to the defendant or the company who posted bail upon meeting all of the conditions of bail; hence being a “conditional loan.”

Bail bonds are a service provided to a cosigner where a bail bond company agrees to help. The expectation is that the defendant meets all of the conditional requirements outlined for his/her case. If conditions are not met, bail is kept by the courts and the cosigner is then legally responsible for repaying the loan in full. If conditions are met, bail is returned to the bail bond company and the only responsibility for the cosigner is that of the agreed upon service fee. 

Bail is set at different amounts typically depending on the severity of the crime committed. A judge will read over the case and assign a bail amount. The judge has the sole discretion of approving or denying bail. If bail is denied for any reason, a bail bond company will not be able to help. 

What if the Terms of the Bail Bond are Violated?

Again, a bail bond is a conditional release. If the defendant violates the terms outlined in his/her bail or fails to show up for assigned court dates, a warrant will be issued for his/her immediate arrest. A judge revoking a bail bond is very serious. Court dates are expected to be met and very little leniency is granted when it comes to dates, times, or forfeiture of outlined conditions. If you are aware in advance that the defendant will not be able to appear to court on the assigned date, it is essential that you contact Gallagher immediately.

The timeline for release varies based primarily on the location of the individual being held.
