PLANTATION, Florida – Cohen and Juda, P.A., a personal injury law firm located in Plantation, Florida, anticipate the passage of a Florida bill that would, among other things, allow a court to impose a fine for certain boating collisions and accidents. House Bill 493 and Senate Bill 606, both titled "Boating Safety" and referred to as the "Boating Safety Act of 2022," were introduced by Senator Ileana Garcia (R-Miami) and Representative Adam Botana (R-Bonita Springs).

If passed, the Boating Safety Act of 2022 seeks to establish a program through the Fish and Wildlife Conservation Commission (FWC) to track citations and send notices of mandatory boater safety education requirements. The bill aims to provide a comprehensive approach to improving safety for residents and visitors along Florida's waterways. The bill has unanimously passed every committee in the Florida House and Senate as of February 21, 2022, and is set to take effect on July 1, 2022, once signed into law by the governor.

The proposed Boating and Safety Act of 2022 addresses careless vessel operation by requiring liveries to provide customers with instructions on operating a livery vessel safely. A lack of proper knowledge is frequently cited as a significant issue by law enforcement and residents in South Florida and attributed as the primary cause of most accidents and fatalities according to the FWC's 2020 Boating Accident Statistical Report (2020 Report). As indicated in the 2020 Report, there were 837 reportable boating accidents and 79 boating-related fatalities in the calendar year 2020.

"While we are hopeful that the anticipated passage of the "Boating Safety Act of 2022" will reduce the number of boating accidents and fatalities, we recognize that boating accidents will still occur due to faulty equipment and operator error, resulting in serious injuries and even death. At Cohen and Juda, we have 22 years of experience representing clients who have been victims of boating accidents. We handle all legal matters relating to a client’s case, including determining the amount or type of compensation they may be entitled to from the party or parties who may be liable for their boating injuries,” says partner Gary Juda.
